A former insurance broker, living in southern Sarthe, was tried this Thursday, March 3, 2022 by the Criminal Court of Mans (Sarthe) for “attempted fraud and false denunciation”.
Shaved head, regular features, blue eyes, dressed in a very elegant black coat, jeans and a pair of ankle boots, he explains himself in impeccable French and with a correction rarely seen in this court room on the facts with which he is charged.
The 45-year-old man is accused of having simulated the burglary of his home on March 22, 2021 and of having filed a false complaint in order to receive insurance.
But the 40-year-old, who was an insurance broker for 15 years and who is changing career paths, explains that he was indeed the victim of a burglary on March 22, 2021 between 12:00 p.m. and 12:45 p.m. when he was went to walk his dog and then go shopping. They allegedly stole two synthesizers, a computer, a television and the sum of 300 euros.
“It doesn’t fit”
But the gendarmes do not believe in his version.
Their investigation leads them to think that he would have organized the theft himself to collect the insurance. According to the gendarmes, “it does not fit” both in the story and in the findings. They find, for example, that the window is not sufficiently forced…

The gendarmes also consider it very suspicious that the man has reported 11 thefts of roughly the same type of object, the value of which varies between 10 and 30,000 euros, and that he regularly changes insurance company.
An insurance company also claims that he tried to extract 21,000 euros from him…

In his indictment, the prosecutor returned to the elements put forward by the gendarmes which tend to prove the guilt of the defendant.
She affirmed that the cross-checks of the investigators converge on an obvious fact: there was no burglary and therefore the complaint is based on a lie. Denouncing the fact that he mobilized the gendarmes for nothing, the prosecutor required from the defendant 140 hours of Works of General Interest (TIG) before declaring: “Let him stop defrauding insurance companies”.

Questioning all the elements of the file, “the procedure, the contradiction of the locksmith’s findings by the insurance expert, irrefutable proof that his client was not at home at the time of the events”, he ended his argument by asking that his client be released.
Relaxed for the benefit of the doubt
Believing that there were “as many elements in one direction as in the other” but that above all “the doubt benefits the accused”, the court acquitted the defendant “for the benefit of the doubt”.
